As it is, he's stuck with it. I dislike his jurisprudence, but I can't blame him for not participating in a practice he finds unhelpful. Maybe he should go full-on Miles Davis and turn his chair around ... or just not attend the arguments.Anonymousnoreply@blogger.comtag:blogger.com,1999:blog-5739125502680107097.post-26470297008894714812014-03-03T13:34:01.241-05:002014-03-03T13:34:01.241-05:00Toobin attempted to use the axiom, better to remai...Toobin attempted to use the axiom, better to remain silent and be thought a fool than to speak and to remove all doubt, against Justice Thomas. Instead the same axiom was used against Toobin.FlameCCThttps://www.blogger.com/profile/16224320341646250188noreply@blogger.comtag:blogger.com,1999:blog-5739125502680107097.post-37213334631503157782014-03-03T12:23:04.909-05:002014-03-03T12:23:04.909-05:00Thomas' refusal to ask questions is basically ...Thomas' refusal to ask questions is basically a silent protest against what he regards as his colleagues' untoward practice of interrupting the lawyers (and each other) when they ask questions. It's amazing to me how much attention this draws without anyone bothering to examine whether Thomas' somewhat old-fashioned view of oral argument manners is correct.Anonymousnoreply@blogger.comtag:blogger.com,1999:blog-5739125502680107097.post-54280953833955678662014-03-03T10:15:45.326-05:002014-03-03T10:15:45.326-05:00Have there been cases where no Justice asked all t...Have there been cases where no Justice asked all the "important" questions? Is it the case that J. Thomas need not ask questions because his colleagues are covering all the bases that need covering? Or is it the case that the other 8 are not competently covering the issues on which the briefs and lower court records are not complete? Anonymousnoreply@blogger.com
